The foxholes saved my Americans from what would have otherwise been a punishing bombardment. Instead they mostly shrugged it off and only a couple squads broke under fire. This makes the foxholes a 'must buy' for the American, IMO.
The American 60mm mortar and MG fire made it costly for the Germans to get up the hill, and not one, but TWO heroes generated on a forward position made it tough for the Germans to seize ground. Nonetheless Stephen persevered only to come toe-to-toe with hidden Americans who dished out substantial close range firepower. I had some good dice on my rally and fire attacks when I needed it and ran up the German body count so that by turn 5 Stephen had to make some very aggressive moves which ended badly for him.
At no time did the Germans outnumber the Americans on the Level 2 hill hexes and, with the casualties piling up with Americans safely ensconced in the treeline, Stephen conceded at the end of turn 5.

German win
Hard to say if the scenario is balanced. As American I was unable to kill Germans moving in the open not using advance movement with 20 FP and a -1 leader. The German FFE landed where it was supposed to and it allowed him to advance through LOS covered terrain of orchards. By the time I could shoot I rolled poorly and before I knew what hit me I was down 2.5 squads vs .5 German squads and he had three turns. Although the buy your own fortifications is fun, not a scenario I would recommend. I believe that the balance is with the attacker.

German win
After the German 7TH "12" rolled on MCs I conceded on turn 5, just not enough Germans to take the hill. The 122mm OBA did okay, but hit a bunch of squads on a corrected attack, but failed to do enough damage, just breaking squads. American mortars were getting hits and effects on concealed squads making it even more difficult for the Germans to stay on the hill.
